These terms and conditions are entered into by and between the photographer and the client Client for the provision of photography services subject to the following terms and conditions:
1. Booking and Payment:
1.1 Client shall secure the Photographer's services by signing a contract and paying a non-refundable booking fee.
1.2 The remaining balance shall be paid prior to or on the day of the photoshoot.
2. Copyright and Usage:
2.1 The Photographer retains the copyright and ownership of all photographs taken.
2.2 The Client is granted personal usage rights for non-commercial purposes only.
2.3 The Client agrees not to edit, modify, or sell any photographs without the Photographer's written consent.
2.4 The Photographer may use the photographs for promotional purposes, including social media and website publication, unless otherwise agreed upon.
3. Cancellation and Rescheduling:
3.1 Cancellation by the Client must be notified in writing with at least 7 days' notice. The booking fee is non-refundable.
3.2 In the event of unavoidable circumstances such as illness or inclement weather, the Client and Photographer shall make reasonable agreements.
4. Confidentiality:
4.1 The Photographer acknowledges that during the provision of photography services, they may have access to personal and confidential information about the Client.
4.2 The Photographer agrees to keep all such information confidential and not disclose it to any third party without the Client's written consent, except as required by law.
5. Data Protection:
5.1 The Photographer respects the Client's privacy and commits to handling all personal data in accordance with applicable data protection laws.
5.2 The Photographer shall only collect, store, and process personal data necessary for the provision of photography services and shall not use it for any other purpose without the Client's consent.
6. Security:
6.1 The Photographer shall take reasonable measures to protect digital photographs and personal data from unauthorized access, loss, disclosure, or alteration.
6.2 The Photographer shall not be liable for any loss or damage resulting from unauthorized access to or loss of digital photographs or personal data, except as a result of their negligence or willful misconduct.
